This notice explains what personal information By Damian collects through this website, why, who handles it, and what you can do about it.

1.Who is responsible

By Damian is a business run by Luis Damián Rodríguez Trujillo (the “controller”), with address at [FULL ADDRESS: street, number, neighborhood, ZIP code, city], Jalisco, Mexico. Luis Damián Rodríguez Trujillo is also the person in charge of protecting your personal information.

2.What I collect

Through the AI assistant on this site, only what you choose to share:

  • Business information: its name, type, location, how customers reach it, and what you say about its website and customers.
  • Approximate figures you provide (monthly inquiries and the value of a customer) and the estimate the assistant calculates.
  • Your contact details, only if you provide them: name, email and/or phone number, and your preferred contact method.
  • The full conversation, with the time of each message. If you leave before the end, what you wrote up to that point is kept.

Through visits to the site: aggregated usage statistics collected by a privacy-friendly analytics tool, such as pages viewed, approximate region, device type and how you arrived. These statistics are not used to identify you personally or for advertising.

I do not request sensitive personal information (such as health, financial account, religious or political information). Please do not share it in the chat.

3.Why I use it

Necessary purposes (required to give you what you ask for):

  1. Show you a conceptual mockup of what your website could look like.
  2. Respond to your request and contact you about it, if you left your details.
  3. Prepare for a call or meeting you request, and send you a quote.

Optional purposes (you can say no):

  1. Improve this website and the AI assistant.
  2. Send you occasional follow-up messages about my services after your first request.

You can refuse the optional purposes at any time by emailing damiantrujillo340@gmail.com with the subject “Opt out”. Refusing them will not affect the necessary purposes.

I do not sell or rent your personal information.

4.Service providers that process it for me

Your information is processed on my behalf, and only to run this website, by:

  • Website hosting provider.
  • Google (Gmail and Google Sheets), where conversations are received and stored.
  • An artificial intelligence provider, which processes the conversation so the assistant can understand and reply.
  • The analytics tool that counts visits.
  • Calendly and WhatsApp, only if you choose to use them; they handle what you give them under their own privacy policies.

These providers may store information outside your country, including in the United States. I do not transfer your personal information to other third parties for their own purposes. If that ever changes, I will ask for your consent first.

5.How long I keep it

If we do not work together, I keep conversations and contact details for 12 months, then delete them. If you become a client, I keep what is necessary for our work and for legal, accounting and tax obligations.

6.Your rights

You can, at any time:

  • Access the personal information I have about you.
  • Correct it if it is inaccurate or incomplete.
  • Delete it.
  • Object to its use for specific purposes.
  • Withdraw your consent and limit how your information is used or disclosed.

How to make a request: email damiantrujillo340@gmail.com with (1) your full name, (2) the email or phone number you used, (3) a clear description of your request, and (4) if needed, a document that confirms your identity. I will respond within 20 business days and, if your request is valid, carry it out within the following 15 business days.

If you are in Mexico, these are your ARCO rights under the Federal Law on the Protection of Personal Data Held by Private Parties (2025). If you believe your rights were not respected, you may contact the competent Mexican authority, currently the Secretaría Anticorrupción y Buen Gobierno. Depending on where you live (for example, the United States or Canada), you may have similar rights under your local laws, and you can use the same email to exercise them.

7.Cookies and similar technologies

  • Chat memory: the assistant uses your browser’s temporary session storage so the conversation is not lost if you reload the page. It is erased when you close the tab or press “Start over”.
  • Analytics: visits are measured with a privacy-friendly tool that does not use advertising cookies and does not track you across other websites.
  • Do Not Track: this site does not track you across other websites, so it does not respond differently to “Do Not Track” browser signals.

8.Security

I use reputable providers and limit access to your information to myself. No system connected to the internet is completely secure, but I take reasonable administrative and technical measures to protect what you share.

9.Minors

This website is meant for business owners. It is not directed to people under 18, and I do not knowingly collect their information. If you believe a minor has shared information, write to me and I will delete it.

10.Changes to this notice

If this notice changes, I will publish the new version on this page and update the date at the top. If a change affects how your information is used in a significant way, I will notify the people whose contact details I have.

11.Consent

By using the AI assistant and providing your information, you agree to its processing as described in this notice. You can withdraw your consent at any time as explained in section 6.

En cumplimiento de la Ley Federal de Protección de Datos Personales en Posesión de los Particulares, publicada en el Diario Oficial de la Federación el 20 de marzo de 2025, se emite el presente Aviso de Privacidad Integral.

I.Identidad y domicilio del responsable

Luis Damián Rodríguez Trujillo, quien opera bajo el nombre comercial “By Damian”, con domicilio en [DOMICILIO COMPLETO: calle, número, colonia, código postal, municipio], Jalisco, México, es responsable del tratamiento de sus datos personales.

II.Datos personales que se tratan

  • Datos de identificación y contacto: nombre, correo electrónico, número telefónico y medio de contacto preferido.
  • Datos del negocio: nombre, giro, ubicación, canales por los que lo contactan sus clientes e información sobre su sitio web.
  • Cifras aproximadas proporcionadas por usted (consultas mensuales y valor de un cliente) y el estimado que calcula el asistente.
  • El contenido de la conversación con el asistente de inteligencia artificial, con la hora de cada mensaje, incluso si la conversación no se concluye.
  • Estadísticas agregadas de navegación (páginas vistas, región aproximada, tipo de dispositivo y origen de la visita).

No se tratan datos personales sensibles. Le pedimos no compartirlos en la conversación.

III.Finalidades del tratamiento

Finalidades necesarias, que dan origen a la relación con usted:

  1. Mostrarle un ejemplo conceptual de cómo podría verse su sitio web.
  2. Atender su solicitud y contactarlo respecto de ella, si proporcionó sus datos de contacto.
  3. Preparar la llamada o reunión que solicite y, en su caso, enviarle una cotización.

Finalidades voluntarias, que no son necesarias para atender su solicitud y para las cuales puede negar su consentimiento:

  1. Mejorar este sitio web y el asistente de inteligencia artificial.
  2. Enviarle mensajes ocasionales de seguimiento sobre los servicios de By Damian.

Si no desea que sus datos se traten para las finalidades voluntarias, envíe un correo a damiantrujillo340@gmail.com con el asunto “No acepto finalidades voluntarias”. Su negativa no afectará las finalidades necesarias.

IV.Encargados y transferencias

Sus datos son tratados por cuenta del responsable, y únicamente para operar este sitio, por los siguientes encargados: proveedor de alojamiento web, Google (Gmail y Google Sheets), un proveedor de inteligencia artificial, una herramienta de estadísticas de visitas y, solo si usted decide usarlos, Calendly y WhatsApp. Estos proveedores pueden almacenar información fuera de México, incluyendo Estados Unidos.

No se realizan transferencias de sus datos personales a terceros para fines propios de ellos. Si en el futuro se requiriera alguna transferencia que necesite su consentimiento, se le solicitará previamente.

V.Conservación

Si no se establece una relación comercial, los datos se conservan durante 12 meses y después se eliminan. Si se convierte en cliente, se conservarán los datos necesarios para la relación y para el cumplimiento de obligaciones legales, contables y fiscales.

VI.Derechos ARCO, revocación del consentimiento y limitación del uso

Usted tiene derecho a Acceder a sus datos, Rectificarlos, Cancelarlos y Oponerse a su tratamiento para fines específicos (derechos ARCO), así como a revocar su consentimiento y a limitar el uso o divulgación de sus datos.

Para ejercerlos, envíe un correo a damiantrujillo340@gmail.com que contenga:

  1. Su nombre completo y el correo o teléfono que utilizó.
  2. Los documentos que acrediten su identidad o, en su caso, la representación legal.
  3. La descripción clara de los datos y del derecho que desea ejercer.
  4. Cualquier elemento que facilite la localización de sus datos.

Se le responderá en un plazo máximo de 20 días hábiles contados desde la recepción de su solicitud y, si resulta procedente, se hará efectiva dentro de los 15 días hábiles siguientes. La respuesta se enviará al correo desde el que hizo la solicitud.

Si considera que su derecho a la protección de datos personales ha sido vulnerado, puede acudir a la autoridad competente, actualmente la Secretaría Anticorrupción y Buen Gobierno.

VII.Uso de tecnologías de rastreo

  • El asistente utiliza el almacenamiento temporal de sesión de su navegador para no perder la conversación si recarga la página. Se borra al cerrar la pestaña o al presionar “Start over”.
  • Las visitas se miden con una herramienta de estadísticas que no utiliza cookies publicitarias ni lo rastrea en otros sitios web.

VIII.Menores de edad

Este sitio está dirigido a dueños de negocios y no a personas menores de 18 años. No se recaban de forma intencional datos de menores. Si detecta que un menor compartió información, escriba al correo de contacto y será eliminada.

IX.Cambios al aviso de privacidad

Cualquier cambio a este aviso se publicará en esta misma página, actualizando la fecha de la parte superior. Si el cambio afecta de forma relevante el tratamiento de sus datos, se notificará a las personas cuyos datos de contacto se tengan.

X.Consentimiento

Al utilizar el asistente y proporcionar sus datos, usted consiente su tratamiento conforme a este aviso. Puede revocar su consentimiento en cualquier momento conforme a la sección VI.
